On 19 October 2018, the Albanian Helsinki Committee (AHC) addressed to the Commissioner for Protection from Discrimination, through a complaint with the object: On Discrimination of Persons with Medical Measures, “Compulsory Medication in a Medical Institution” and Patients with Security Measures “Temporary Hospitalization in a Psychiatric Hospital”, illegally accommodated in penitentiary institutions.
Based on the legal protection offered by our legal framework at the convention level but also by domestic legislation, referring to all the facts, legal arguments, AHC monitoring reports, reports and recommendations of the Ombudsman and the CPT, AHC estimates that persons to whom the court has imposed the security measure “Temporary Hospitalization in a Psychiatric Hospital” and / or the medical measure “Compulsory Medication in a Medical Institution” have been accommodated in flagrant violations of the law and are discriminated in relation to patients with the same diagnosis , which are cured and treated in psychiatric hospitals of public sector.
